What is a Costs and Case Management Conference?

A costs and case management conference (CCMC) is a type of hearing that takes place prior to to litigation proceedings in order to discuss the directions of the trial and the costs associated with it. A CCMC is an important factor in the legal process due to it directing the way a case will play out.

During a costs and case management conference the parties’ costs budgets will also be assessed if the parties have not been able to reach an agreement.

How to prepare for a CCMC

Prior to a CCMC taking place, all parties should have their costs budgets prepared with their expected recoverable costs. A well-prepared costs budget can determine the costs you are awarded at the end of the process, so it is important for it to be completed correctly. Parties also should fill out a statement of truth document in relation to the validity of the Precedent H costs budget.

Additionally, seven days before your costs and case management hearing, parties should also ensure their costs budget negotiations are clearly stated in a costs budget discussions report, which is also known as a Precedent R. If parties fail to file the Precedent R then the opposing parties budget will be seen as uncontested and their full budget will be approved.

What happens during a Cost and Case Management Conference

Following the completion of all of the relevant documents then the CCMC can take place. The court will check all deadlines and directions have been complied with and sign them off. The court will then consider the estimated costs associated with the dispute and consider how reasonable and proportionate they are in relation to the value of the claim that is going to trial.
