The purpose of a Precedent H is to promote transparency and proportionality. Once a budget is approved or agreed, it will usually act as a cap on recoverable costs for each phase, unless there is good reason for the Court to depart from it.

A costs budget is required in most multi-track cases. Where the value of the claim is below £50,000, the budget is not required in full and typically only the front sheet must be completed, subject to the Court’s discretion.

The deadlines for filing a Precedent H Cost Budget are strict and should be treated as critical. If the claim is pleaded at £50,000 or less, the budget should usually be filed with the Directions Questionnaire. The budget should not include VAT, success fees, or LEI premiums within the main figures. The costs of preparing the budget and the costs management process itself should also be excluded from the central totals, although they are reflected in the percentage allowances on the front sheet.

Costs incurred for interim applications, such as applications to vary directions, are usually dealt with separately at the end of the case.

If a party fails to file a Precedent H Cost Budget on time, or files one late without good reason, the Court is likely to impose sanctions. In many cases, this results in the defaulting party being limited to recovering court fees only, regardless of the work undertaken.

Although an application for relief from sanctions can be made, such applications are not guaranteed to succeed and must be supported by a clear explanation for the default.
